1. Scope of Application
These General Terms and Conditions of Sale apply to all sales of products made via the HYMAGE website to purchasers who are consumers or professionals.
2. Orders
Orders can be placed on the website www.hymage.com. Confirmation of the order implies acceptance of these GTC, acknowledgement of full knowledge of them and waiver of the right to invoke one’s own terms and conditions of purchase or other conditions.
3. Prices
The prices of our products are indicated in euros, inclusive of all taxes (VAT included), excluding delivery costs. HYMAGE reserves the right to modify its prices at any time, but products will be invoiced on the basis of the prices in force at the time of order confirmation.
4. Payment
Payment is due immediately upon placing the order. You can pay by credit card, bank transfer, or any other method offered on the website. The order will only be processed after payment has been received and validated.
5. Shipping
Delivery will be made to the address you provided when placing your order. Delivery times are provided for information purposes only; if they exceed thirty days from the date of order, the sales contract may be terminated and the purchaser reimbursed, with the exception of special orders or custom-made items.
6. Warranty and After-Sales Service
Our products are covered by the legal guarantee of conformity and the guarantee against hidden defects. In the event of non-conformity of a product sold, it may be returned to HYMAGE, which will take it back, exchange it or refund it.
7. Right of Withdrawal
In accordance with current legislation, consumers have a period of 14 days from receipt of their order to exercise their right of withdrawal without having to justify their reasons or pay a penalty. This right of withdrawal excludes special or customised orders.
8. Liability
HYMAGE cannot be held liable for failure to perform the contract in the event of stock shortages or product unavailability, force majeure, disruption or total or partial strikes, particularly of postal services and means of transport and/or communications.
9. Intellectual Property
All elements of the HYMAGE website are and remain the exclusive intellectual property of HYMAGE. No one is authorised to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the website, whether in the form of photographs, logos, visuals, or text.
10. Personal Data
HYMAGE undertakes to preserve the confidentiality of information provided by the purchaser, which may be transmitted for the use of certain services. All information concerning purchasers is treated with the strictest confidentiality.
11. Disputes
These terms and conditions of distance selling are subject to the law of the country where HYMAGE is based. In the event of a dispute, an amicable solution will be sought before any legal action is taken.
